Opiner provides the Platform as a technology provider. This Agreement is between Project Management Institute UK ("Client") and members ("Responders") of its Project Management Institute UK ("Community"). Opiner is not responsible for the Client's decisions, questions, incentives or use of responses, and does not verify the accuracy of Responder submissions.
Definitions
- Client means Project Management Institute UK, the organisation running the Community on the Platform.
- Community means Project Management Institute UK, the Client's community space on the Platform.
- Responder means an individual who joins (or applies to join) the Community and submits Responses via the Platform.
- Response means any content submitted by a Responder via the Platform (including video responses and any accompanying text or metadata) in answer to the Client's questions.

- Your Responses may be kept for for 3 years, and the Client is responsible for deleting them at the end of that period.
- Your Responses will be downloaded for use outside the Platform. If they are downloaded, the Client must store, use and delete them in line with this Agreement.
- Who can view your Responses: public.
- Your Responses will be used for research, engagement (knowledge and experiences) and marketing (publicly visible) activities.
- You keep ownership of your Response, but you give the Client a non-exclusive, worldwide, royalty-free licence to use it as described in this Agreement (including the Key points and section 5).
- Incentives are optional and may vary by question. Possible incentives include: participation.
- Do not share sensitive information unless you are comfortable with the selected response access level and the intended usage.
- This Platform is not an emergency service and is not for medical advice.
- Keep your account secure: do not share login details, and contact the Client’s community manager or Opiner support if you suspect unauthorised access.
- If you leave the Community, Responses you already submitted may still be available to the Client and used for the agreed purposes during the retention period (unless deletion is required by law or otherwise agreed).
1. Purpose and scope
1.1 Opiner provides a video-based research platform where Responders can share insights, opinions, and experiences by submitting Responses to questions created by the Client. The purpose of these terms is to ensure smooth, respectful, and productive engagement between all parties.
2. Community participation
2.1 Anyone aged 16 or over who meets the Client's target responder profile, as outlined on the community sign-up page and in the Responder app, can apply to join the Community through the Opiner app by submitting a response to the welcome question. The Client has sole discretion to approve or deny applications. Some communities may have limited capacity, which could result in a waitlist.
2.2 Responders agree to participate voluntarily and submit their video responses through the Opiner app in response to the Client's questions. Participation is based on the Responder's willingness to engage in the research process and provide truthful and insightful answers.
2.3 Responders retain ownership of the content they provide. The license granted to the Client, and how responses may be used, are set out in section 5 and the Key points.
2.4 The Client has the sole discretion to remove any Responder from the community at any time, for any reason.
3. Respectful communication
3.1 All communication on the Platform must be respectful and professional. Offensive language, hate speech, or discriminatory comments will not be tolerated.
3.2 No spam or promotional content: Responders must refrain from submitting unsolicited marketing content, spam, or promotional material.
3.3 Responders must not upload content that is unlawful, infringes third-party rights, or breaches confidentiality obligations. The Client and/or Opiner may remove such content and may suspend access.
4. Confidentiality and privacy
4.1 Responder video responses will be accessible as public and are intended for use in research, engagement (knowledge and experiences) and marketing (publicly visible). Responders should avoid sharing special category data or other sensitive information unless it is necessary and they are comfortable sharing it at the selected access level.
4.2 Where response access or usage includes public visibility (for example marketing/public), Responders acknowledge that content may be viewed, copied, shared, or stored by others outside Opiner's control.
4.3 The Client is the Data Controller for personal data collected and used for the purposes of the Community (including Responses), and determines how and why that data is processed. Opiner processes personal data to operate the Platform and may process data on the Client's behalf where applicable.
4.4 All collected data will be stored securely and used in compliance with applicable privacy laws, including but not limited to GDPR (General Data Protection Regulation) or any relevant data protection laws.
5. Intellectual property
5.1 The Responder retains ownership of their response. By submitting a response, the Responder grants the Client a non-exclusive, worldwide, royalty-free license to use the response for a period of for 3 years in activities relating to research, engagement (knowledge and experiences) and marketing (publicly visible), at the response access level set out in the Key points.
5.2 The Client owns the rights to any research insights derived from Responder submissions, including but not limited to aggregated and anonymised data.
5.3 The Client may use video responses for research analysis, presentations, reports, and other forms of publication. Personal identifiers may be removed to ensure anonymity unless otherwise specified by the Responder.
5.4 The Client may not sell Responder submissions to third parties. The Client may share or publish submissions only as set out in this Agreement (including any selected usage rights and access level) or where required by law.
6. Compensation and rewards
6.1 The client will choose on a question by question whether to offer incentives from: participation.
7. Code of conduct
7.1 Responders must provide honest and thoughtful responses.
7.2 Responders should respect the views of others in the community, and avoid engaging in negative or destructive commentary.
7.3 Responders must ensure the content they upload is accurate to the best of their knowledge and avoid submitting misleading or false information.
7.4 Responders are responsible for protecting their login information and keeping their account secure. Responders must not share their login details with anyone and should take reasonable steps to prevent unauthorised access (for example, using a strong password and keeping their device secure).
7.5 If a Responder suspects their account has been compromised, misused, or accessed by someone else, they should contact the Client's community manager or Opiner support as soon as possible.
8. Termination of engagement
8.1 Responders may withdraw their participation at any time by notifying the Client or Opiner. Upon withdrawal, the Responder's access to the Platform may be revoked.
8.2 Opiner and the Client reserves the right to terminate a Responder's participation in the community for any violation of these terms, including but not limited to disrespectful behavior, failure to comply with submission guidelines, or any other actions deemed detrimental to the integrity of the research process.
8.3 If a Responder withdraws or their participation ends, Responses already submitted may remain available to the Client and usable in line with this Agreement (including the license in section 5 and the retention period). Where deletion is required by law, or otherwise agreed in writing, the Client and/or Opiner will take reasonable steps to delete or restrict access to the relevant content.
9. Limitation of liability
9.1 To the maximum extent permitted by law, Opiner is not responsible for any loss, damage, or legal claims arising from the use of the Platform, the content submitted, or participation in the video-based research process. Opiner does not exclude or limit liability where it would be unlawful to do so.
9.2 The Platform is provided on an "as is" and "as available" basis. Opiner does not guarantee that the Platform will be uninterrupted, secure, error-free, or available at all times, and may suspend or restrict access for maintenance, upgrades, or security reasons.
9.3 To the maximum extent permitted by law, the Responder agrees to indemnify and hold harmless the Client and Opiner from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with the Responder's breach of this Agreement or any allegation that the Responder's Response infringes a third party's rights or is unlawful.
10. Changes to terms
10.1 The Client reserves the right to update these Community Terms of Engagement as necessary. Any changes will be communicated to the Client and community members in advance. Responders will not be able to submit further responses until they have accepted the updated terms.
11. Governing law
11.1 This Agreement shall be governed by and construed in accordance with the laws of England and Wales.
11.2 Any disputes shall be resolved in the courts of England and Wales.
11.3 This Agreement shall be interpreted in English, and in the event of any translation inconsistencies, the English version shall prevail.
12. Acceptance
12.1 By participating in Opiner's video-based research, both the Client and Responder acknowledge and accept the terms outlined above.
